Article D231-3 of the French Cinema and Moving Image Code

The application for exemption is sent to the President of the Centre national du cinéma et de l’image animée by the holder of the video publishing rights.

It must be accompanied by the following information and documents:

1° The title, the number of the cinematographic licence and the date of release of the work in cinematographic theatres;

2° The date from which exploitation of the work in videogram form is planned;

3° A statement from the holder of the rights to screen the work in cinemas specifying the number of admissions achieved at the end of the fourth cinema week.

The Centre national du cinéma et de l’image animée may request any additional information or documents it deems useful.

Article D231-3

La demande de dérogation est adressée au président du Centre national du cinéma et de l’image animée par le titulaire des droits d’édition vidéographique.

Elle est accompagnée des renseignements et documents suivants :

1° Le titre, le numéro du visa d’exploitation cinématographique et la date de sortie en salles de spectacles cinématographiques de l’œuvre ;

2° La date à compter de laquelle l’exploitation de l’œuvre sous forme de vidéogrammes est prévue ;

3° Une déclaration du titulaire des droits d’exploitation de l’œuvre cinématographique en salles précisant le nombre d’entrées réalisées à l’issue de la quatrième semaine cinématographique.

Le Centre national du cinéma et de l’image animée peut demander tous renseignements ou documents complémentaires qu’il estime utiles.
