Article D2371-1 of the French Labour Code

Where the directors of the companies participating in the formation of a company resulting from a cross-border transaction decide that its registered office shall be located on French territory, the draft terms of formation of that company shall specify that the special negotiating body provided for in Article L. 2372-1 shall be formed at the location of that registered office.

Lorsque les dirigeants des sociétés participant à la constitution d’une société issue de l’opération transfrontalière décident que son siège est établi sur le territoire français, le projet de constitution de cette société précise que le groupe spécial de négociation prévu à l’article L. 2372-1 est constitué au lieu de ce siège.
