Article D31 of the French Code of Criminal Procedure

The provisions of this paragraph shall not apply:

1° Where there is only one examining magistrate;

2° Where there is an investigation involving an accused under the age of eighteen and there is only one examining magistrate with special responsibility for cases involving minors;

3° Where the examining magistrate present at the scene of a flagrant crime or offence is seised by virtue of article 72 of the Code of Criminal Procedure.

Les dispositions du présent paragraphe ne sont pas applicables :

1° Lorsqu’il n’existe qu’un juge d’instruction ;

2° Lorsqu’il s’agit d’une information comportant une personne mise en examen mineure de dix-huit ans et qu’il n’existe qu’un juge d’instruction chargé spécialement des affaires concernant les mineurs ;

3° Lorsque le juge d’instruction présent sur les lieux d’un crime ou délit flagrant est saisi en vertu de l’article 72 du code de procédure pénale.
