Article D312-5 of the French Code governing the entry and residence of foreign nationals and the right of asylum

The chairman of the committee referred to in article D. 312-3 is chosen from among persons who have served as head of a diplomatic or consular post.

In addition, the committee comprises:

2° A representative of the Minister of Foreign Affairs;

3° A representative of the Minister of Immigration;

> A representative of the Minister of the Interior;

A representative of the Minister of the Interior
4° A representative of the Minister for the Interior;

The members of the Commission are appointed by decree of the Prime Minister for a period of three years. A first and a second vice-chairman and, for each of the members of the commission mentioned in the four preceding paragraphs, a first and a second deputy are appointed under the same conditions.
Either of the vice-chairmen may sit on the committee in place of the chairman, on the latter’s appointment. If the Chairman is absent or unable to attend, his duties shall be performed by the First Vice-Chairman and, if the latter is unavailable, by the Second Vice-Chairman.

Article D312-5

Le président de la commission mentionnée à l’article D. 312-3 est choisi parmi les personnes ayant exercé des fonctions de chef de poste diplomatique ou consulaire.

La commission comprend, en outre :

1° Un membre, en activité ou honoraire, de la juridiction administrative ;

2° Un représentant du ministre des affaires étrangères ;

3° Un représentant du ministre chargé de l’immigration ;

4° Un représentant du ministre de l’intérieur.

Les membres de la commission sont nommés par décret du Premier ministre pour une durée de trois ans. Un premier et un second vice-présidents ainsi que, pour chacun des membres de la commission mentionnés aux quatre alinéas précédents, un premier et un second suppléants, sont nommés dans les mêmes conditions.

L’un ou l’autre des vice-présidents peut siéger à la commission en lieu et place du président, sur désignation de celui-ci. En cas d’absence ou d’empêchement du président, ses fonctions sont assurées par le premier vice-président et, en cas d’indisponibilité de ce dernier, par le second vice-président.
