Article D32-11 of the French Code of Criminal Procedure

The investigating judge or the liberty and custody judge who issued the house arrest order informs the person under investigation that:

1° In the event that he or she fails to comply with the obligations imposed, the house arrest order may be revoked and he or she may be remanded in custody.

2° The fitting of the bracelet containing a transmitter provided for in article R. 57-11 may be carried out without his consent, but that refusing to have this device fitted constitutes a breach of his obligations that may result in his house arrest being revoked and him being remanded in custody.

This information is mentioned in the minutes of the adversarial debate provided for in the first paragraph of article 142-6 or the presentation of the person before the magistrate provided for in that paragraph.

Article D32-11

Le juge d’instruction ou le juge des libertés et de la détention qui a prononcé l’assignation à résidence informe la personne mise en examen que :

1° Dans le cas où elle ne respecterait pas les obligations qui lui sont imposées, l’assignation à résidence pourra être révoquée et elle pourra être placée en détention provisoire.

2° La pose du bracelet comportant un émetteur prévu à l’article R. 57-11 ne peut être effectuée sans son consentement, mais que le fait de refuser la pose de ce dispositif constitue une violation de ses obligations pouvant donner lieu à la révocation de son assignation à résidence et à son placement en détention provisoire.

Ces informations font l’objet d’une mention dans le procès-verbal du débat contradictoire prévu par le premier alinéa de l’article 142-6 ou de la présentation de la personne devant le magistrat prévu par cet alinéa.
