Article D32-13 of the French Code of Criminal Procedure

If house arrest with electronic surveillance is ordered when a person is released, the information provided for in articles D. 32-11 and D. 32-12 are included in the order.

The investigating judge or the liberty and custody judge may decide that his order is made subject to the condition precedent that the device provided for in article 723-8 and that the person’s release is subject to the fitting of the bracelet containing a transmitter provided for in Article R. 57-11. In this case, the order states that this installation cannot be carried out without the person’s consent, but that if the person refuses it, the order will lapse.

Si l’assignation à résidence avec surveillance électronique est ordonnée à l’occasion d’une mise en liberté, les informations prévues par les articles D. 32-11 et D. 32-12 figurent dans l’ordonnance.

Le juge d’instruction ou le juge des libertés et de la détention peut décider que son ordonnance est prise sous condition suspensive d’installation du dispositif prévu à l’article 723-8 et que la mise en liberté de la personne est subordonnée à la pose du bracelet comportant un émetteur prévu à l’article R. 57-11. Dans ce cas, l’ordonnance indique que cette pose ne peut être effectuée sans le consentement de la personne, mais que si celle-ci la refuse, l’ordonnance sera caduque.
