Article D32-17 of the French Code of Criminal Procedure

The prior agreement of the investigating judge provided for by article 142-9 for the hours of presence at home or in the places of assignment to be modified by the head of the penitentiary establishment or by the director of the penitentiary integration and probation service, provided that the changes are favourable to the person under investigation and do not affect the balance of the supervision measure, shall be mentioned in the order deciding on the house arrest.

If this agreement is given after the measure has been imposed, it is set out in a separate document that is sent without delay to the head of the prison or the director of the probation service.

The judge may decide to withdraw this agreement at any time during the procedure. He must then inform the head of the penitentiary establishment or the director of the penitentiary integration and probation service without delay.

Article D32-17

L’accord préalable du juge d’instruction prévu par l’article 142-9 pour que les horaires de présence au domicile ou dans les lieux d’assignation soient modifiés par le chef d’établissement pénitentiaire ou par le directeur du service pénitentiaire d’insertion et de probation, dès lors qu’il s’agit de modifications favorables à la personne mise en examen ne touchant pas à l’équilibre de la mesure de contrôle, est mentionné dans l’ordonnance décidant de l’assignation à résidence.

Si cet accord est donné postérieurement au prononcé de la mesure, il figure dans un document distinct qui est adressé sans délai au chef d’établissement pénitentiaire ou au directeur du service pénitentiaire d’insertion et de probation.

Le juge peut à tout moment de la procédure décider de retirer cet accord. Il doit alors en informer sans délai le chef d’établissement pénitentiaire ou le directeur du service pénitentiaire d’insertion et de probation.
