Article D33 of the French Code of Criminal Procedure

When an investigating judge issues a letter rogatory to a judicial police officer in charge of a police service or gendarmerie unit, the latter may have it executed by a judicial police officer under his authority, provided that the latter acts within the limits of his territorial jurisdiction.

The judicial police officer entrusted with the execution of a letter rogatory by his hierarchical superior must, without prejudice to the application of the provisions of Article D. 9, immediately report back to the instructing magistrate if the latter has ordered this to be done.

Lorsqu’un juge d’instruction adresse une commission rogatoire à un officier de police judiciaire chef d’un service de police ou d’une unité de gendarmerie, celui-ci peut en faire assurer l’exécution par un officier de police judiciaire placé sous son autorité, à condition que ce dernier agisse dans les limites de sa compétence territoriale.

L’officier de police judiciaire chargé de l’exécution d’une commission rogatoire par son chef hiérarchique doit, sans préjudice de l’application des dispositions de l’article D. 9, en rendre compte immédiatement au magistrat mandant si celui-ci a prescrit cette diligence.
