Article D331-38 of the French Cinema and Moving Image Code

The executive production company eligible for the tax credit provided for in article 220 quaterdecies of the French General Tax Code is the one responsible, under a contract entered into with a production company whose head office is located outside France, for bringing together the technical and artistic resources for the production of the film or audiovisual work in question, and for managing the physical production operations for this work and ensuring that they are carried out correctly. The contract stipulates that the production company whose head office is located outside France has taken the initiative to produce the work, assumes responsibility for it and retains control over it.

L’entreprise de production exécutive pouvant bénéficier du crédit d’impôt prévu à l’article 220 quaterdecies du code général des impôts est celle chargée, en application d’un contrat conclu avec une entreprise de production dont le siège est situé hors de France, d’une part, de réunir les moyens techniques et artistiques en vue de la réalisation de l’œuvre cinématographique ou audiovisuelle concernée, d’autre part, d’assurer la gestion des opérations matérielles de fabrication de cette œuvre et de veiller à leur bonne exécution. Le contrat conclu stipule que l’entreprise de production dont le siège est situé hors de France a pris l’initiative de la réalisation de l’œuvre, en assume la responsabilité et en conserve la maîtrise.
