Article D3311-4 of the French General Code of Local Authorities

The chapters of budgets voted by nature correspond:

a) Investment section:

– to each of the two-digit accounts in classes 1 and 2 open to the nomenclature by nature, with the exception of the accounts “Retained earnings”, “Profit for the financial year”, “Provisions for liabilities and charges”, “Differences on realisation of fixed assets”, “Fixed assets assigned, conceded, leased or made available”, “Depreciation of fixed assets”, “Provisions for depreciation of fixed assets”.

– to each of the globalised chapters, the list and composition of which are set by the order provided for in article L. 3312-2;

– to each programme voted by the deliberative assembly. The programme corresponds to a set of acquisitions of fixed assets, work on fixed assets and related study costs, leading to the completion of a work or several works of the same nature ;

– to the “RMI” global expenditure and revenue chapters, one of which records all expenditure and the other all investment revenue relating to the minimum integration income;

– to each of the transactions on behalf of third parties, the list and subdivisions of which are determined by the order provided for in article L. 3312-2;

– to the “Equipment subsidies paid” account;

– on the expenditure side, to the line entitled “Unforeseen expenditure”;

– on the revenue side, to the line entitled “Transfer from the operating section”.

– on the revenue side, on the line entitled “Proceeds from disposals of fixed assets”;

These last three chapters include only forecasts with no realisations.

b) Operating section:

– to the two-digit accounts of classes 6 and 7 open to the nomenclature by nature, with the exception of accounts forming part of globalised chapters;

– to each of the globalised chapters, the list and composition of which are set by the decree provided for in Article L. 3312-2;

– to the globalised “RMI” expenditure and revenue chapters, one of which tracks all expenditure and the other all operating revenue relating to the minimum integration income;

– to the globalised “APA” expenditure and revenue chapters, one of which tracks all expenditure and the other all operating revenue relating to the personalised autonomy allowance ;

– on the revenue side, to the account entitled “Local taxes”;

– on the expenditure side, to the account entitled “Elected representatives’ group operating expenses”;

– on the expenditure side, to the line entitled “Unforeseen expenditure”;

– on the expenditure side, to the line entitled “Transfer to the investment section”.

These last two chapters contain only forecasts with no realisations.

– à chacun des comptes à deux chiffres des classes 1 et 2 ouverts à la nomenclature par nature, à l’exception des comptes ” Report à nouveau “, ” Résultat de l’exercice “, ” Provisions pour risques et charges “, ” Différences sur réalisations d’immobilisations “, ” Immobilisations affectées, concédées, affermées ou mises à disposition “, ” Amortissements des immobilisations “, ” Provisions pour dépréciation des immobilisations “.

– à chacun des chapitres globalisés dont la liste et la composition sont fixées par l’arrêté prévu à l’article L. 3312-2 ;

– à chaque programme voté par l’assemblée délibérante. Le programme correspond à un ensemble d’acquisitions d’immobilisations, de travaux sur immobilisations et de frais d’études y afférents, aboutissant à la réalisation d’un ouvrage ou de plusieurs ouvrages de même nature ;

– aux chapitres globalisés de dépenses et de recettes ” RMI ” retraçant l’un l’ensemble des dépenses et l’autre l’ensemble des recettes d’investissement relatives au revenu minimum d’insertion ;

– à chacune des opérations pour le compte de tiers, dont la liste et les subdivisions sont déterminées par l’arrêté prévu à l’article L. 3312-2 ;

– au compte ” Subventions d’équipement versées ” ;

– en dépenses, à la ligne intitulée ” Dépenses imprévues ” ;

– en recettes, à la ligne intitulée ” Virement de la section de fonctionnement “.

– en recettes, à la ligne intitulée ” Produits des cessions d’immobilisations ” ;

Ces trois derniers chapitres ne comportent que des prévisions sans réalisation.

b) Section de fonctionnement :

– aux comptes à deux chiffres des classes 6 et 7 ouverts à la nomenclature par nature, à l’exception des comptes faisant partie de chapitres globalisés ;

– à chacun des chapitres globalisés, dont la liste et la composition sont fixées par l’arrêté prévu à l’article L. 3312-2 ;

– aux chapitres globalisés de dépenses et de recettes ” RMI ” retraçant l’un l’ensemble des dépenses et l’autre l’ensemble des recettes de fonctionnement relatives au revenu minimum d’insertion ;

– aux chapitres globalisés de dépenses et de recettes ” APA ” retraçant l’un l’ensemble des dépenses et l’autre l’ensemble des recettes de fonctionnement relatives à l’allocation personnalisée à l’autonomie ;

– en recettes, au compte intitulé ” Impôts locaux ” ;

– en dépenses, au compte intitulé ” Frais de fonctionnement des groupes d’élus ” ;

– en dépenses, à la ligne intitulée ” Dépenses imprévues ” ;

– en dépenses, à la ligne intitulée ” Virement à la section d’investissement “.

Ces deux derniers chapitres ne comportent que des prévisions sans réalisation.
