Article D3665-3 of the French General Code of Local Authorities

The revenues of the Lyon metropolitan authority, the metropolitan authority’s public establishments and any public body resulting from an agreement between the metropolitan authority and any other public authority or public establishment, which are not assessed and liquidated by the State’s tax departments in execution of the laws and regulations in force, are recovered:

1° Either by virtue of enforceable judgements or contracts;

2° Or by virtue of revenue orders or tax rolls issued and made enforceable as far as the metropolis is concerned by the president of the council of the metropolis and as far as the public establishments are concerned by the authorising officer of these establishments.

Enforcement measures for the recovery of these products are carried out as in matters of direct taxation.

However, the authorising officer shall authorise these compulsory enforcement measures in accordance with the procedures set out in article R. 1617-24.

Oppositions, where the matter falls within the jurisdiction of the judicial courts, are judged as summary matters.

Les produits de la métropole de Lyon, des établissements publics de la métropole et de tout organisme public résultant d’une entente entre la métropole et toute autre collectivité publique ou établissement public, qui ne sont pas assis et liquidés par les services fiscaux de l’Etat en exécution des lois et règlements en vigueur, sont recouvrés :

1° Soit en vertu de jugements ou de contrats exécutoires ;

2° Soit en vertu de titres de recettes ou de rôles émis et rendus exécutoires en ce qui concerne la métropole par le président du conseil de la métropole et en ce qui concerne les établissements publics par l’ordonnateur de ces établissements.

Les mesures d’exécution forcée pour le recouvrement de ces produits sont effectuées comme en matière de contributions directes.

Toutefois, l’ordonnateur autorise ces mesures d’exécution forcée selon les modalités prévues à l’article R. 1617-24.

Les oppositions, lorsque la matière est de la compétence des tribunaux judiciaires, sont jugées comme affaires sommaires.
