Article D4011-4-2 of the French Public Health Code

I.-The manager of one of the entities mentioned in articles L. 4011-4-1 to L. 4011-4-3 declares the implementation of a local cooperation protocol mentioned in I of the same articles to the director general of the regional health agency with territorial jurisdiction, using a dedicated online application on the website of the Ministry of Health. He must submit the protocol and its appendices to this application, together with the following supporting documents for each member of the team:

signed and dated commitment agreement;

-copy of an identity document;

-registration number on the medical register or specific professional file and supporting documents;

-sworn statement that the skills required to implement the protocol have been acquired.

The date on which the protocol is declared constitutes the date on which the protocol is actually implemented.

II – Each year, the person responsible referred to in I sends the Director General of the regional health agency with territorial jurisdiction the data relating to the monitoring indicators for local protocols using a dedicated online application on the website of the Ministry of Health. These monitoring indicators provide information on at least :

the number of patients treated under the protocol;

-the rate of repeat procedures by delegating healthcare professionals, which corresponds to the number of procedures carried out by the delegating healthcare professional on the delegate’s call, compared with the number of procedures carried out by the delegate;

-the nature and rate of adverse events, where applicable, which corresponds to the number of adverse events reported compared with the number of procedures carried out by the delegate;

-the satisfaction rate of healthcare professionals adhering to the protocol, which corresponds to the number of professionals who answered “satisfied” or “very satisfied” in relation to the number of professionals who expressed their level of satisfaction using a dedicated questionnaire.

The head of one of the entities referred to in Articles L. 4011-4-2 and L. 4011-4-3 shall inform the social life council or the users’ commission, as appropriate, of the implementation of the protocol and shall forward any observations made by this body to the Director General of the regional health agency with territorial jurisdiction.

The latter shall forward the cooperation protocol to the regional health conference for information and shall inform it of the conditions under which it is implemented.

III. – When proposing the deployment of a cooperation protocol, the Director General of the regional health agency with territorial jurisdiction shall inform the regional health conference of the conditions under which it is implemented.When it proposes the deployment of a local protocol throughout the national territory in application of Article L. 4011-4-6, the National Committee for Interprofessional Cooperation shall first ensure that the protocol meets the conditions necessary for this deployment, and in particular the quality and safety requirements defined by Article R. 4011-1, in conjunction with the system, the medico-social establishment or service implementing the protocol and the national councils and professional orders concerned.

Once this examination has been completed, the committee sends the protocol to the Haute Autorité de santé for its opinion, together with any proposed amendments.

In the light of this opinion, the protocol may be deployed throughout France by order of the ministers responsible for health and social security.

I.-Le responsable de l’une des entités mentionnées aux articles L. 4011-4-1 à L. 4011-4-3 déclare la mise en œuvre d’un protocole local de coopération mentionné au I des mêmes articles au directeur général de l’agence régionale de santé territorialement compétent au moyen d’une application en ligne dédiée du site internet du ministère chargé de la santé. Il dépose sur cette application le protocole et ses annexes ainsi que, pour chaque membre de l’équipe, les pièces justificatives suivantes :

-accord d’engagement daté et signé ;

-copie d’une pièce d’identité ;

-numéro d’enregistrement au tableau ordinal ou fichier professionnel spécifique et son justificatif ;

-attestation sur l’honneur de l’acquisition des compétences exigées pour la mise en œuvre du protocole.

La date de déclaration du protocole constitue la date de mise en œuvre effective du protocole.

II.-Le responsable mentionné au I transmet annuellement au directeur général de l’agence régionale de santé territorialement compétente les données relatives aux indicateurs de suivi des protocoles locaux au moyen d’une application en ligne dédiée du site internet du ministère chargé de la santé. Ces indicateurs de suivi renseignent au minimum sur :

-le nombre de patients ayant été pris en charge au titre du protocole ;

-le taux de reprise par les professionnels de santé délégants, qui correspond au nombre d’actes réalisés par le délégant sur appel du délégué par rapport au nombre d’actes réalisés par le délégué ;

-la nature et le taux d’événements indésirables s’il y a lieu, qui correspond au nombre d’événements indésirables déclarés par rapport au nombre d’actes réalisés par le délégué ;

-le taux de satisfaction des professionnels de santé adhérents au protocole, qui correspond au nombre de professionnels ayant répondu “ satisfait ” ou “ très satisfait ” par rapport au nombre de professionnels ayant exprimé leur niveau de satisfaction au moyen d’un questionnaire dédié.

Le responsable de l’une des entités mentionnées aux article L. 4011-4-2 et L. 4011-4-3 informe, selon les cas, le conseil de la vie sociale ou la commission des usagers sur la mise en œuvre du protocole et transmet les observations éventuelles de cette instance au directeur général de l’agence régionale de santé territorialement compétente.

Celui-ci transmet pour information le protocole de coopération à la conférence régionale de santé et l’informe de ses conditions de mise en œuvre.

III.-Lorsqu’il propose le déploiement d’un protocole local sur tout le territoire national en application de l’article L. 4011-4-6, le comité national des coopérations interprofessionnelles s’assure au préalable que le protocole répond aux conditions nécessaires à ce déploiement et notamment aux exigences de qualité et de sécurité définies par l’article R. 4011-1, en lien avec le dispositif, l’établissement ou le service médico-social mettant en œuvre le protocole et les conseils nationaux et les ordres professionnels concernés.

A l’issue de cet examen, il transmet pour avis le protocole, avec d’éventuelles propositions de modification, à la Haute Autorité de santé.

Au regard de cet avis, le protocole peut être déployé sur tout le territoire national par arrêté des ministres chargés de la santé et de la sécurité sociale.
