A commission, attached to the Conseil national de l’ordre des médecins, the Conseil national de l’ordre des chirurgiens-dentistes and the Conseil national de l’ordre des sages-femmes respectively, is responsible for evaluating the practice of refusing care by healthcare professionals registered with each of these orders.
These commissions assess the number and nature of practices involving refusal of care by any means they deem appropriate. In particular, they may use studies, situation tests and patient surveys. They analyse these practices, their nature, causes and trends. They produce statistical data based on these analyses. They issue recommendations aimed at putting an end to these practices and improving patient information. They do not rule on individual situations.
On the basis of their work and after hearing the organisations of the profession recognised as representative within the meaning ofarticle L. 162-33 of the Social Security Code, these commissions each submit an annual report to the Minister for Health, by 30 June at the latest. Each national council of the medical profession will make this report public within one month of it being sent to the Minister for Health.
