Article D4154-3 of the French Labour Code

The employer may be authorised, pursuant to the second paragraph of Article L. 4154-1, to employ employees holding a fixed-term employment contract or temporary employees to carry out the work mentioned in Article D. 4154-1.
The application for authorisation is sent to the Regional Director of Business, Competition, Consumer Affairs, Labour and Employment by registered letter with acknowledgement of receipt. It shall be accompanied by the opinion of the social and economic committee and the opinion of the occupational physician.

L’employeur peut être autorisé, en application du second alinéa de l’article L. 4154-1, à employer des salariés titulaires d’un contrat de travail à durée déterminée ou des salariés temporaires pour accomplir les travaux mentionnés à l’article D. 4154-1.
La demande d’autorisation est adressée au directeur régional des entreprises, de la concurrence, de la consommation, du travail et de l’emploi par lettre recommandée avec avis de réception. Elle est accompagnée de l’avis du comité social et économique ainsi que de l’avis du médecin du travail.
