Article D420-3 of the French Monetary and Financial Code

The AMF shall communicate to the European Securities and Markets Authority and to the competent authorities of the other Member States of the European Union or parties to the Agreement on the European Economic Area the information referred to in II of Article L. 420-9.

With regard to conduct that may be indicative of conduct prohibited under Regulation (EU) No 596/2014 of the European Parliament and of the Council of 16 April 2014 on market abuse, the Autorité des marchés financiers shall inform the competent authorities of the other Member States or parties to the Agreement on the European Economic Area and the European Securities and Markets Authority only when it is satisfied that such conduct is being or has been committed.

L’Autorité des marchés financiers communique à l’Autorité européenne des marchés financiers et aux autorités compétentes des autres Etats membres de l’Union européenne ou parties à l’accord sur l’Espace économique européen les informations mentionnées au II de l’article L. 420-9.


En ce qui concerne les conduites susceptibles d’être révélatrices d’un comportement interdit en vertu du règlement (UE) n° 596/2014 du Parlement européen et du Conseil du 16 avril 2014 sur les abus de marché, l’Autorité des marchés financiers n’en informe les autorités compétentes des autres Etats membres ou parties à l’accord sur l’Espace économique européen et l’Autorité européenne des marchés financiers que lorsqu’elle est convaincue que ledit comportement est ou a été commis.
