Article D4331-1-1 of the French Public Health Code

In the context of performing professional occupational therapy procedures prescribed by a doctor, occupational therapists are entitled to prescribe, unless otherwise indicated by the doctor, medical devices and technical aids, the list of which is laid down by order of the ministers responsible for health and social security, issued after consulting the Académie nationale de médecine.

They shall inform the prescribing doctor and, where appropriate, with the patient’s consent, the treating doctor, of the prescription made.

This article does not apply to occupational therapists employed by a service provider and equipment distributor within the meaning of article D. 5232-1 or by a medical device manufacturer within the meaning of article L. 5211-3-1.

Article D4331-1-1

Dans le cadre de la réalisation d’actes professionnels d’ergothérapie prescrits par un médecin, l’ergothérapeute est habilité à prescrire, sauf indication contraire du médecin, les dispositifs médicaux et aides techniques dont la liste est fixée par arrêté des ministres chargés de la santé et de la sécurité sociale, pris après avis de l’Académie nationale de médecine.

Il informe le médecin prescripteur et, le cas échéant, avec l’accord du patient, le médecin traitant, de la prescription effectuée.

Le présent article n’est pas applicable aux ergothérapeutes salariés d’un prestataire de services et distributeur de matériels au sens de l’article D. 5232-1 ou d’un fabricant de dispositif médical au sens de l’article L. 5211-3-1.
