Article D4362-13 of the French Public Health Code

In the event of loss or breakage of corrective ametropic lenses, where an emergency is established and in the absence of a suitable medical solution, the optician may exceptionally issue new equipment without a prescription after carrying out a refractive examination.

The optician gives the patient the result of the refractive examination carried out and forwards it by any appropriate means to the prescriber or to the doctor designated by the patient, except in cases where the prescription is issued in a country other than France.

The optician will record in a register these exceptional deliveries of optical equipment without a prescription in order to ensure traceability.

This data is kept by the optician for a period of three years.

En cas de perte ou de bris des verres correcteurs d’amétropie, lorsque l’urgence est constatée et en l’absence de solution médicale adaptée, l’opticien-lunetier peut exceptionnellement délivrer sans ordonnance un nouvel équipement après avoir réalisé un examen réfractif.

L’opticien-lunetier remet au patient le résultat de l’examen de réfraction réalisé et le transmet par tout moyen adapté au prescripteur ou au médecin désigné par le patient, à l’exception des cas où l’ordonnance est établie dans un autre Etat que la France.

L’opticien-lunetier consigne dans un registre ces délivrances exceptionnelles d’équipement optique sans ordonnance afin d’en assurer la traçabilité.

Ces données sont conservées par l’opticien-lunetier pendant un délai de trois ans.
