Article D45-22 of the French Code of Criminal Procedure

Where the accused declares to limit, in accordance with the second paragraph of Article 502, the scope of his appeal on the public prosecution to the penalties imposed, to some of them or to the terms of their application, the form of the statement of appeal made pursuant to articles 502 or 503 must include a statement informing the appellant of his right to go back on this limitation, by means of a supplementary statement, within one month of the appeal being lodged and in accordance with the procedures set out in the first and third paragraphs of article 502 or the first and second paragraphs of article 503.

This specifies that if the limitation of the scope of the appeal on the public prosecution to the sentences handed down was not made by the accused’s lawyer or by the accused in the presence of his lawyer, the accused may also go back on this limitation at the hearing.

Where the statement of appeal is made by the accused in person, it shall specify whether or not it was made in the presence of his lawyer.

The limitation on the accused’s appeal in accordance with the first paragraph shall have no effect if the public prosecutor lodges an appeal against the entire decision handed down on the public prosecution, including during a cross-appeal. If the accused withdraws the limitation on his appeal within one month, the parties have a further period of five days in which to lodge a cross-appeal.

Lorsque le prévenu déclare limiter, conformément au deuxième alinéa de l’article 502, la portée de son appel sur l’action publique aux peines prononcées, à certaines d’entre elles ou à leurs modalités d’application, le formulaire de la déclaration d’appel faite en application des articles 502 ou 503 doit comporter une mention informant l’appelant de son droit de revenir sur cette limitation, par une déclaration complémentaire, dans le mois suivant l’acte d’appel et selon les modalités prévues au premier et troisième alinéas de l’article 502 ou au premier et deuxième alinéas de l’article 503.

Cette mention précise que si la limitation de la portée de l’appel sur l’action publique aux peines prononcées n’a pas été faite par l’avocat du prévenu ou par le prévenu en présence de son avocat, le prévenu pourra également revenir sur cette limitation à l’audience.

Lorsque la déclaration d’appel est faite par le prévenu en personne, elle précise si elle a été faite en présence ou non de son avocat.

La limitation de l’appel du prévenu conformément au premier alinéa est sans effet si le ministère public forme appel sur l’ensemble de la décision rendue sur l’action publique, y compris lors d’un appel incident. Si le prévenu revient sur la limitation de son appel dans le délai d’un mois, les parties disposent d’un nouveau délai de cinq jours pour former appel incident.
