Article D47-1-7 of the French Code of Criminal Procedure

For the application of articles 694-25 and 694-26, the practical arrangements for the temporary transfer or transit of a person, including, where appropriate, details of the conditions of detention in the issuing or executing State, and the time limits by which he or she is to be transferred from and returned to the territory of the executing State shall be determined by mutual agreement between the issuing State and the executing State, ensuring that the physical and mental condition of the person concerned, as well as the level of security required in the issuing State, are taken into account.

Pour l’application des articles 694-25 et 694-26, les modalités pratiques du transfèrement temporaire ou du transit d’une personne, y compris s’il y a lieu le détail de ses conditions de détention dans l’Etat d’émission ou l’Etat d’exécution, et les dates limites auxquelles elle doit être transférée du territoire de l’Etat d’exécution et renvoyée sur ce territoire sont fixées d’un commun accord entre l’Etat d’émission et l’Etat d’exécution, en veillant à ce que l’état physique et mental de la personne concernée, ainsi que le niveau de sécurité requis dans l’Etat d’émission, soient pris en compte.
