For the application of the provisions of Article 706-49 relating to informing the children’s judge in the event of the opening of educational assistance proceedings, must be referred to the magistrate of the public prosecutor’s office specialising in juvenile matters.
The public prosecutor or investigating judge informs the children’s judge hearing the educational assistance proceedings, throughout the criminal proceedings, of decisions that may affect relations between the parents and their children. The investigating judge may seek the opinion of the juvenile court judge before taking these decisions. This opinion is then placed in the proceedings file.
The children’s judge is informed of the outcome of criminal investigations, in particular in the event of the case being dismissed, an alternative to prosecution, the initiation of public proceedings, a settlement order or a judgment.
