Article D47-29-2 of the French Code of Criminal Procedure

To allow the immediate application of the order provided for by articles D. 47-29 and D. 47-29-1, the public prosecutor shall inform the State representative or, in Paris, the police prefect in advance of hearings at which the investigating chamber or the trial court is likely to order involuntary hospitalisation in accordance with the provisions of l’article 706-135.

The fact that the investigating chamber or the trial court does not order such hospitalisation does not prevent the representative of the State or, in Paris, the Prefect of Police from applying the provisions of articles L. 3213-1 and L. 3213-7 of the public health code.

Pour permettre l’application immédiate de l’ordonnance prévue par les articles D. 47-29 et D. 47-29-1, le ministère public informe préalablement le représentant de l’Etat ou, à Paris, le préfet de police des audiences au cours desquelles la chambre de l’instruction ou la juridiction de jugement est susceptible d’ordonner une hospitalisation d’office conformément aux dispositions de l’article 706-135.


Le fait que la chambre de l’instruction ou la juridiction de jugement n’ordonne pas cette hospitalisation n’interdit pas au représentant de l’Etat ou, à Paris, au préfet de police de faire application des dispositions des articles L. 3213-1 et L. 3213-7 du code de la santé publique.
