Article D47-37-6 of the French Code of Criminal Procedure

If the assize court answers in the affirmative to the question provided for in Article D. 47-37-5, it must then rule on the following question:

“Has the accused materially committed the act of which he is accused and for which he has been deemed not criminally responsible? “

If the court answers this question in the affirmative, Articles 706-130 and 706-131 providing that the Assize Court shall pronounce a judgment declaring no criminal responsibility on grounds of mental disorder and that the Court shall rule on damages and interest and, if applicable, security measures.

The provisions of article 706-132 providing for appeals by the public prosecutor, the accused and the civil party are then applicable.

Si la cour d’assises répond positivement à la question prévue par l’article D. 47-37-5, elle doit alors statuer sur la question suivante :


“ L’accusé a-t-il matériellement commis le fait qui lui est reproché et pour lequel il a été considéré comme pénalement non responsable ? ”


Si la cour répond positivement à cette question, il est fait application des articles 706-130 et 706-131 prévoyant que la cour d’assises prononce un arrêt portant déclaration d’irresponsabilité pénale pour cause de trouble mental et que la cour statue sur les dommages et intérêts et, s’il y a lieu, les mesures de sûreté.


Les dispositions de l’article 706-132 prévoyant l’appel du procureur général, de l’accusé et de la partie civile sont alors applicables.
