Article D47-37-7 of the French Code of Criminal Procedure

If the assize court answers in the negative to the question provided for in article D. 47-37-5, it orders the accused to be transferred to a subsequent hearing of the Assize Court, which proceeds in the same way as in the case of a transfer ordered by the investigating court. This committal decision may not be appealed.

If the accused was placed under a committal order, he shall remain detained in accordance with the provisions of Article 181, without prejudice to his ability to request his release at any time. The time limits laid down in paragraphs eight and nine of Article 181 shall apply.

The Assize Court ruling on a referral is not bound by the answer given by the first Assize Court to the question provided for by Article D. 47-37-5.

Si la cour d’assises répond négativement à la question prévue par l’article D. 47-37-5, elle ordonne le renvoi de l’accusé à une audience ultérieure de la cour d’assises qui procède comme en cas de renvoi prononcé par la juridiction d’instruction. Cette décision de renvoi ne peut faire l’objet d’un appel.


Si l’accusé était placé sous mandat de dépôt, il demeure détenu conformément aux dispositions de l’article 181, sans préjudice de sa possibilité de demander à tout moment sa mise en liberté. Les délais prévus par les dispositions des alinéas huit et neuf de l’article 181 sont applicables.


La cour d’assises statuant sur renvoi n’est pas tenue par la réponse apportée par la première cour d’assises à la question prévue par l’article D. 47-37-5.
