Article D48-1-1 of the French Code of Criminal Procedure

The thresholds of six months’ or one year’s imprisonment provided for in terms of sentence adjustment by the third paragraph of Article 132-19 and Article 132-25 of the Criminal Code, as well as by 1°, 2° and 3° of I of Article 464-2, Article 474 and the article 723-15 of this code shall be assessed taking into account, where appropriate, of:

1° The total or partial revocation of a simple suspended sentence or a probationary suspended sentence, decided by the trial court and the duration of which is added, in accordance with Articles 132-38 and 132-50 of the Penal Code, to that of the prison sentence that may be served;

2° The intervention of pre-trial detention, the duration of which is deducted in full, in accordance with Article 716-4 of this Code, from that of the prison sentence handed down.

Les seuils de six mois ou un an d’emprisonnement prévus en matière d’aménagement de peine par le troisième alinéa de l’article 132-19 et l’article 132-25 du code pénal, ainsi que par les 1°, 2° et 3° du I de l’article 464-2, l’article 474 et l’article 723-15 du présent code s’apprécient en prenant en compte, le cas échéant, de :


1° La révocation totale ou partielle d’un sursis simple ou d’un sursis probatoire, décidée par la juridiction de jugement et dont la durée s’ajoute, conformément aux articles 132-38 et 132-50 du code pénal, à celle de la peine d’emprisonnement pouvant être exécutée ;


2° L’intervention d’une détention provisoire dont la durée est intégralement déduite, conformément à l’article 716-4 du présent code, de celle de la peine d’emprisonnement prononcée.
