Article D48-20 of the French Code of Criminal Procedure

Where the public prosecutor is considering applying the provisions set out in 1° of Article D. 48-22 or 4°, 6° and 7° of Article D. 48-23, it shall inform the competent authority of the issuing State without delay by any means that leaves a written record, so that the latter may, if appropriate, submit its observations.

After ensuring that the request is in order, the public prosecutor shall enforce the financial penalty.

Lorsque le procureur de la République envisage de faire application des dispositions prévues au 1° de l’article D. 48-22 ou aux 4°, 6° et 7° de l’article D. 48-23, il en informe sans délai par tout moyen laissant une trace écrite l’autorité compétente de l’Etat d’émission, afin que celle-ci puisse, le cas échéant, produire ses observations.

Après s’être assuré de la régularité de la demande, le procureur de la République met à exécution la sanction pécuniaire.

Il fait exécuter la sanction pécuniaire et en informe sans délai l’autorité judiciaire de l’Etat d’émission par tout moyen laissant une trace écrite.
