Article D48-6 of the French Code of Criminal Procedure

The financial penalties that may be enforced pursuant to the fifth paragraph of Article 707-1 are those resulting from a decision, taken by the competent authority of a Member State of the European Union, known as the issuing State, imposing, definitively, on a natural or legal person the payment of a :

1° sum of money imposed as a sentence for an offence;

2° compensation awarded to victims where they are unable to bring a civil action, ordered as part of the same decision and in the exercise of the court’s criminal jurisdiction;

3° A sum of money relating to the costs of the judicial or administrative proceedings that led to the decision;

4° A sum of money allocated to a public fund or a victim support organisation, ordered in the context of the same decision.

Article D48-6

Les sanctions pécuniaires pouvant être exécutées en application du cinquième alinéa de l’article 707-1 sont celles qui résultent d’une décision, prise par l’autorité compétente d’un Etat membre de l’Union européenne, appelé Etat d’émission, imposant, à titre définitif, à une personne physique ou morale le paiement d’une :

1° Somme d’argent prononcée à titre de condamnation pour une infraction ;

2° Indemnité allouée aux victimes lorsqu’elles ne peuvent se constituer partie civile, ordonnée dans le cadre de la même décision et dans l’exercice de la compétence pénale de la juridiction ;

3° Somme d’argent afférente aux frais de la procédure judiciaire ou administrative ayant conduit à la décision ;

4° Somme d’argent allouée à un fonds public ou à une organisation de soutien aux victimes, ordonnée dans le cadre de la même décision.
