Article D513-11-1 of the French Public Health Code

For the purposes of this chapter, the following definitions shall apply

1° “Collection”: the collection of faeces as defined in 2°, under the responsibility of the establishment or body mentioned in Article L. 513-11-1 ;

2° “Stools”: stools of human origin intended for the preparation of faecal microbiota used for therapeutic purposes, collected in the context of Article L. 513-11-1, subject only to the steps necessary for their preservation and intended for use in the composition of the medicinal products mentioned in 3° and 4° ;

3° “Preparation of faecal microbiota”: the magistral or hospital preparation mentioned in Article L. 5121-1, prepared from the faeces defined in 2°;

4° “Medicinal product containing faecal microbiota”: any medicinal product prepared from the faeces defined in 2° and the manufacture of which does not include any stage intended to isolate one or more of its components;

5° “Importation of faeces and preparations of faecal microbiota”: any entry into the customs territory, excluding transit through or through the customs territory, of faeces as defined in 2° and preparations of faecal microbiota as defined in 3°.

Article D513-11-1

Pour l’application du présent chapitre, on entend par :

1° “Collecte” : le recueil des selles définies au 2°, sous la responsabilité de l’établissement ou de l’organisme mentionné à l’article L. 513-11-1 ;

2° “Selles” : les selles d’origine humaine destinées à la préparation de microbiote fécal utilisé à des fins thérapeutiques, collectées dans le cadre de l’article L. 513-11-1, soumises aux seules étapes nécessaires à leur conservation et destinées à entrer dans la composition des médicaments mentionnés aux 3° et 4° ;

3° “Préparation de microbiote fécal” : la préparation magistrale ou hospitalière mentionnée à l’article L. 5121-1, préparée à partir des selles définies au 2° ;

4° “Médicament contenant du microbiote fécal” : tout médicament préparé à partir des selles définies au 2° et dont la fabrication ne comporte aucune étape visant à isoler un ou plusieurs de ses composants ;

5° “Importation de selles et de préparations de microbiote fécal” : toute entrée sur le territoire douanier, à l’exclusion du transit ou de l’emprunt du territoire douanier, des selles définies au 2° et des préparations de microbiote fécal définies au 3°.
