Article D514-18 of the French Monetary and Financial Code

Judicial auctioneers or other public officials are allocated a proportional fee on the proceeds of sales, the amount of which is set by decision of the Guidance and Supervisory Board, to cover the costs of the auction and sales.

The establishment may charge a proportional fee on the proceeds of sales, which shall be set in the same manner. It may also levy, for sales of pledged property that have been specially advertised, in the form of catalogues, special notices or public exhibitions, an additional duty on the proceeds of these sales calculated in proportion to the proceeds.

The amount to be charged to buyers or sellers, depending on the case, is set by a decision of the Guidance and Supervisory Board. These duties are added to the auction price.

Il est alloué aux commissaires-priseurs judiciaires ou aux autres officiers ministériels, pour vacation et frais de vente, un droit proportionnel sur le produit des ventes dont la quotité est fixée par délibération du conseil d’orientation et de surveillance.

L’établissement peut percevoir à son profit un droit proportionnel sur le produit des ventes, qui est fixé dans les mêmes formes. Il peut percevoir, en outre, pour les ventes des biens gagés qui ont fait l’objet d’une publicité particulière, sous forme de catalogues, d’avis particuliers ou d’expositions publiques, un droit supplémentaire sur le produit de ces ventes calculé en proportion de celui-ci.

La mise à la charge de ces droits, selon les cas, aux acheteurs ou aux vendeurs, est fixée par une délibération du conseil d’orientation et de surveillance. Ces droits sont ajoutés au montant de l’adjudication.
