Article D5213-53 of the French Labour Code

To qualify for the start-up grant, the disabled worker must satisfy the following conditions:
1° They must not have been convicted of any of the offences listed in Chapter VIII of Title II of Book I of the French Commercial Code;
2° They must meet all the necessary character requirements;
3° If they are not French nationals or nationals of a Member State of the European Union, they must have been resident in France for at least three years at the time of application;
4° They have premises enabling them to practise their profession and meet the usual operating conditions;
5° They hold any diplomas that may be required to practise their profession;
6° They are registered with the National Register of Companies as a business in the trades and crafts sector, with the Trade Register and with professional bodies, where such registration is required to practise their profession.

Pour prétendre à la subvention d’installation, le travailleur handicapé répond aux conditions suivantes :
1° Il n’a subi aucune des condamnations prévues par le chapitre VIII du titre II du livre premier du code de commerce ;
2° Il présente toutes les garanties de moralité nécessaires ;
3° S’il ne possède pas la nationalité française ou celle d’un Etat membre de l’Union européenne, il réside en France depuis trois ans au moins au moment de la demande ;
4° Il dispose d’un local permettant l’exercice de la profession et remplit les conditions habituelles d’exploitation ;
5° Il justifie des diplômes éventuellement exigés pour l’exercice de la profession ;
6° Il est inscrit au Registre national des entreprises en tant qu’entreprise du secteur des métiers et de l’artisanat, au registre du commerce et aux ordres professionnels, lorsque cette inscription est nécessaire pour l’exercice de la profession.
