Article D538 of the French Code of Criminal Procedure

In accordance with the provisions of the first paragraph of Article 731-1, the person is also subject, unless otherwise decided by the sentence enforcement judge or court, to a treatment order in accordance with the procedures applicable to socio-judicial follow-up, if he or she has been convicted of an offence for which this measure is incurred and a medical assessment considers that he or she is likely to undergo treatment.

The convicted offender is then informed by the sentence enforcement judge, prior to his release, that no treatment may be undertaken without his consent, but that if he refuses the treatment offered to him, his conditional release may be revoked.

Conformément aux dispositions du premier alinéa de l’article 731-1, la personne est également soumise, sauf décision contraire du juge ou du tribunal de l’application des peines à une injonction de soins selon les modalités applicables en matière du suivi socio-judiciaire, si elle a été condamnée pour une infraction pour laquelle cette mesure est encourue et qu’une expertise médicale estime qu’elle est susceptible de faire l’objet d’un traitement.

Le condamné est alors avisé par le juge de l’application des peines, avant sa libération, qu’aucun traitement ne pourra être entrepris sans son consentement, mais que s’il refuse les soins qui lui seront proposés, sa libération conditionnelle pourra être révoquée.
