Article D547 of the French Code of Criminal Procedure

When, in application of article 747-1, the firm part of a prison sentence that has been subject to a partial probationary suspension is converted into a sentence of home detention under electronic surveillance, a sentence of community service, a fine-day sentence or imprisonment subject to a reinforced probationary suspension, this decision does not constitute a second conviction within the meaning of article 132-53 of the Criminal Code.

Lorsqu’en application de l’article 747-1, la partie ferme d’une peine d’emprisonnement ayant fait l’objet d’un sursis probatoire partiel est convertie en peine de détention à domicile sous surveillance électronique, en peine de travail d’intérêt général, en peine de jours-amende ou en un emprisonnement assorti d’un sursis probatoire renforcé, cette décision ne constitue pas une seconde condamnation au sens de l’ article 132-53 du code pénal .
