Article D549-5 of the French Monetary and Financial Code

I. – In application of I of Article L. 549-15, the consolidated publication system referred to in the same article makes public the information mentioned in Article D. 549-4.

It also makes public the following information

1° An indicator specifying which derogation the transaction has been subject to, if the obligation to publish the information referred to in Article 3(1) of Regulation (EU) No 600/2014 of the European Parliament and of the Council of 15 May 2014 on markets in financial instruments has been waived as a derogation in accordance with Article 4(1)(a) or (b) of that Regulation ;

2° Where applicable, the fact that a computer algorithm within the investment service provider other than an asset management company is responsible for the investment decision or the execution of the transaction.

II. – Pursuant to II of Article L. 549-15, it shall make public the information mentioned in Article D. 549-4.

Article D549-5

I. – En application du I de l’article L. 549-15, le système consolidé de publication visé au même article rend publiques les informations mentionnées à l’article D. 549-4.

Il rend publiques en outre les informations suivantes :

1° Un indicateur précisant de quelle dérogation la transaction a fait l’objet, si l’obligation de publier les informations visées à l’article 3, paragraphe 1, du règlement (UE) n° 600/2014 du Parlement européen et du Conseil du 15 mai 2014 concernant les marchés d’instruments financiers a été levée à titre de dérogation conformément à l’article 4, paragraphe 1, points a ou b, dudit règlement ;

2° Le cas échéant, le fait qu’un algorithme informatique au sein du prestataire de services d’investissement autre qu’une société de gestion de portefeuille est responsable de la décision d’investissement ou de l’exécution de la transaction.

II. – En application du II de l’article L. 549-15, il rend publiques les informations mentionnées à l’article D. 549-4.
