Article D561-34-1 of the French Monetary and Financial Code

I.-The transmission of information pursuant to the provisions of I of Article L. 561-28 and Articles L. 561-29-1 and L. 561-31 shall be signed by the Director, his deputy or department staff specially appointed for this purpose by the Director.

II – The information memorandum provided for in Article L. 561-30-1 is sent to the Public Prosecutor under the conditions set out in I. Except in emergencies, it shall be accompanied by the opinion given to the Director of the Department by the Legal Adviser, or his deputy, on the nature of the facts.

I.-La transmission d’informations en application des dispositions du I de l’article L. 561-28 et des articles L. 561-29-1 et L. 561-31 est faite sous la signature du directeur, de son adjoint ou d’agents du service spécialement désignés à cette fin par le directeur.

II.-La note d’information prévue à l’article L. 561-30-1 est transmise au procureur de la République dans les conditions prévues au I. Sauf urgence, elle est accompagnée de l’avis donné au directeur du service par le conseiller juridique, ou son adjoint, et portant sur la caractérisation des faits.
