Article D561-35 of the French Monetary and Financial Code

I. – The only persons who may be assigned to the TRACFIN department, after having received prior authorisation, are public servants and employees made available pursuant to Article 13 of Decree no. 85-986 of 16 September 1985 relating to the special status of certain positions of State employees and to certain procedures for making employees available and definitively terminating their duties.

II. – Agents assigned to the TRACFIN department or working under the authority of this department are, if necessary, authorised in accordance with the regulations in force relating to the protection of national defence secrets.

III. – The authorisations provided for in I and II are issued to agents by the Minister for the Economy.

I. – Peuvent seuls être affectés au service TRACFIN, après avoir été préalablement habilités, les agents publics et les agents mis à disposition en application de l’article 13 du décret n° 85-986 du 16 septembre 1985 relatif au régime particulier de certaines positions des fonctionnaires de l’Etat et à certaines modalités de mise à disposition et de cessation définitive de fonctions.

II. – Les agents affectés au service TRACFIN ou travaillant sous l’autorité de ce service sont, si nécessaire, habilités conformément à la réglementation en vigueur relative à la protection des secrets de la défense nationale.

III. – Les habilitations prévues au I et II sont délivrées aux agents par le ministre chargé de l’économie.
