Article D589-4 of the French Code of Criminal Procedure

A handwritten signature collected in digital form is affixed by means of a technical device, after the signatory has become aware of the document in digital format.

It is validly affixed only if, subsequent to its collection, an electronic signature is affixed to the document by a person participating in the proceedings within the meaning of Article 11, or if the secure device referred to in article R. 49-1.

If the person refuses to sign or is unable to sign, this is noted in the document.

La signature manuscrite recueillie sous forme numérique est apposée au moyen d’un dispositif technique, après prise de connaissance par son signataire de l’acte sous un format numérique.


Elle n’est valablement apposée que si, postérieurement à son recueil, il est apposé sur l’acte une signature électronique par une personne concourant à la procédure au sens de l’article 11, ou s’il est recouru à l’appareil sécurisé mentionné à l’article R. 49-1.


Si la personne refuse de signer ou qu’il lui est impossible de signer, il en est fait mention dans l’acte.
