Article D6136-4 of the French Public Health Code

The constitutive agreement includes at least:

1° The objectives pursued by the territorial psychiatric community in terms of psychiatric and mental health services and pathways in accordance with the territorial mental health project and the regional health project;

2° The operational procedures for implementing these objectives between its members and associates and the procedures for coordination with the primary care teams, the territorial professional health communities and the other players involved in the territorial mental health project. The role of the psychiatric sectors in this system is specified in particular;

3° The identification of the resources that its members intend to devote to the community project;

4° The procedures for monitoring and evaluating these objectives;

5° The procedures for including new members;

6° The procedures for cooperation with referral establishments and structures that do not belong geographically to the mental health territory;

7° The procedures for governance of the territorial psychiatric community. The signatories of the constituent agreement may set up bodies. The methods of governance and the representative bodies are adapted to the purpose of the community and to the number and diversity of its actions and members;

8° The arrangements for the participation of representatives of psychiatric and mental health users and their families.

Article D6136-4

La convention constitutive comprend a minima :

1° Les objectifs poursuivis par la communauté psychiatrique de territoire en termes d’offre et de parcours de psychiatrie et de santé mentale conformément au projet territorial de santé mentale et au projet régional de santé ;

2° Les modalités opérationnelles de mise en œuvre de ces objectifs entre ses membres et associés et les modalités de coordination avec les équipes de soins primaires, les communautés professionnelles territoriales de santé et les autres acteurs du projet territorial de santé mentale. La place des secteurs de psychiatrie dans ce dispositif est notamment précisée ;

3° L’identification des ressources que ses membres entendent consacrer au projet de la communauté ;

4° Les modalités de suivi et d’évaluation de ces objectifs ;

5° Les modalités d’inclusion de nouveaux membres ;

6° Les modalités de coopération avec des établissements et structures de recours n’appartenant pas géographiquement au territoire de santé mentale ;

7° Les modalités de gouvernance de la communauté psychiatrique de territoire. Les signataires de la convention constitutive peuvent mettre en place des instances. Les modalités de gouvernance et les instances de représentation sont adaptées à l’objet de la communauté, au nombre et à la diversité de ses actions et de ses membres ;

8° Les modalités de participation des représentants des usagers de la psychiatrie et de la santé mentale et de leurs familles.
