Article D6146-5-1 of the French Public Health Code

The time devoted to the duties of head of department is valued and counted as part of the service obligations of practitioners.

The head of department receives training on taking up his duties, adapted to the exercise of high responsibilities.

At his request, the head of department may also receive training at the end of his term of office, with a view to continuing his activity or resuming all his medical activities.

A functional allowance is paid to the head of department. The amount and terms of payment of this allowance are set by order of the ministers responsible for health, social security and the budget.

This allowance is subject to the supplementary pension scheme instituted by decree no. 70-1277 of 23 December 1970, as amended, creating a supplementary social insurance pension scheme for non-tenured employees of the State and public authorities.

Le temps consacré aux fonctions de chef de service est valorisé et comptabilisé dans les obligations de service des praticiens.


Il bénéficie d’une formation à sa prise de fonction, adaptée à l’exercice de hautes responsabilités.


A sa demande, le chef de service peut également bénéficier d’une formation à l’issue de son mandat, en vue de la suite de son activité ou de la reprise de l’ensemble de ses activités médicales.


Une indemnité de fonction est versée au chef de service. Le montant et les modalités de versement de cette indemnité sont fixés par arrêté des ministres chargés de la santé, de la sécurité sociale et du budget.


Cette indemnité est assujettie au régime de retraite complémentaire institué par le décret n° 70-1277 du 23 décembre 1970 modifié portant création d’un régime de retraites complémentaires des assurances sociales en faveur des agents non titulaires de l’Etat et des collectivités publiques.
