Article D6213-3 of the French General Code of Local Authorities

I. – Part Two of the General Code of Territorial Authorities is applicable to Saint-Barthélemy under the conditions set out in this article.

II. – Book II is applicable to Saint-Barthélemy under the following conditions:

1° Article R. 2214-1 is not applicable to Saint-Barthélemy;

2° Articles R. 2221-1 to R. 2221-99 are not applicable to Saint-Barthélemy;

3° Articles R. 2224-23 à R. 2224-29 are not applicable to Saint-Barthélemy;

4° Article R. 2224-33 shall not apply to Saint-Barthélemy;

5° Articles R. 2241-1 to R. 2242-6 shall not apply to Saint-Barthélemy.

III. – Book IV of Part Two of the General Local Authorities Code is applicable to Saint-Barthélemy under the following conditions:

1° Articles D. 2411-1 to D. 2411-10 are not applicable to Saint-Barthélemy;

2° For the application of Article R. 2421-1, the local authority’s town hall is treated in the same way as the town hall.

Article D6213-3

I. – La deuxième partie du code général des collectivités territoriales est applicable à Saint-Barthélemy dans les conditions prévues au présent article.

II. – Le livre II est applicable à Saint-Barthélemy dans les conditions suivantes :

1° L’article R. 2214-1 n’est pas applicable à Saint-Barthélemy ;

2° Les articles R. 2221-1 à R. 2221-99 ne sont pas applicables à Saint-Barthélemy ;

3° Les articles R. 2224-23 à R. 2224-29 ne sont pas applicables à Saint-Barthélemy ;

4° L’article R. 2224-33 n’est pas applicable à Saint-Barthélemy ;

5° Les articles R. 2241-1 à R. 2242-6 ne sont pas applicables à Saint-Barthélemy.

III. – Le livre IV de la deuxième partie du code général des collectivités territoriales est applicable à Saint-Barthélemy dans les conditions suivantes :

1° Les articles D. 2411-1 à D. 2411-10 ne sont pas applicables à Saint-Barthélemy ;

2° Pour l’application de l’article R. 2421-1, l’hôtel de la collectivité est assimilé à la mairie.
