Article D623-30-1 of the French Intellectual Property Code

The scale of fees for services rendered provided for in the first paragraph of Article L. 623-16 is set by order of the ministers responsible for the budget and agriculture.

This scale determines the amount of the fees corresponding to the costs incurred by the national plant variety authority for:

investigating the application, depending on the species concerned if the examination is carried out in France;

issuing the title;

maintaining the validity of certificates;

other acts carried out with a view to keeping the registers.

It may provide for the payment of an additional fee in the event of late payment.

The order of the ministers responsible for the budget and for agriculture shall also specify the conditions under which the applicant shall pay the costs incurred by the national plant variety authority when it entrusts the examination of a variety to the competent authority of another State or of an intergovernmental organisation that is a member of the International Union for the Protection of New Varieties of Plants.

Le barème des redevances pour service rendu prévues au premier alinéa de l’article L. 623-16 est fixé par arrêté des ministres chargés du budget et de l’agriculture.

Ce barème détermine le montant des redevances correspondant aux frais exposés par l’instance nationale des obtentions végétales pour :

-l’instruction de la demande, en fonction de l’espèce concernée si l’examen est réalisé en France ;

-la délivrance du titre ;

-le maintien de la validité des certificats ;

-les autres actes accomplis en vue de la tenue des registres.

Il peut prévoir le paiement d’un droit supplémentaire en cas de retard de paiement.

L’arrêté des ministres chargés du budget et de l’agriculture précise en outre les conditions dans lesquelles le demandeur s’acquitte des frais exposés par l’instance nationale des obtentions végétales lorsqu’elle confie l’examen d’une variété au service compétent d’un autre Etat ou d’une organisation intergouvernementale membre de l’Union internationale pour la protection des obtentions végétales.
