Article D6232-2 of the French General Code of Local Authorities

To take part in the campaign for the referendum, groups of elected representatives, political parties and groupings that meet the conditions laid down in Article LO 1112-10 submit a request for authorisation to the President of the Territorial Council of Saint-Barthélemy, no later than 5 p.m. on the third Monday before polling day.

Each group of elected representatives attaches a list of its members to its request for authorisation.

Each party or political grouping to which elected representatives or candidates have declared their affiliation under the conditions provided for in Article LO 1112-10 shall attach to its application for authorisation the list of these elected representatives or candidates together with their declaration of affiliation.

An order of the President of the Territorial Council, published or posted no later than the third Friday before polling day, sets out the list of elected groups, parties and political groupings authorised to take part in the campaign as well as the list of persons who declare their affiliation.

Any voter registered in Saint-Barthélemy as well as any group, party or political grouping that has submitted an application for authorisation may, within twenty-four hours of the publication of the list, refer the matter to the administrative court. The court will rule in the first and last instance within three days of the application being lodged.

If it deems the application to be well-founded, the court will amend the order.

For the application of the articles of the Electoral Code (Regulatory part) to the campaign organised with a view to a local referendum, references to candidates and lists of candidates are replaced by references to groups of elected representatives, political parties and groupings.

Pour participer à la campagne en vue du référendum, les groupes d’élus, partis et groupements politiques remplissant les conditions posées par l’article LO 1112-10 présentent une demande d’habilitation au président du conseil territorial de Saint-Barthélemy, au plus tard avant 17 heures le troisième lundi qui précède le jour du scrutin.

Chaque groupe d’élus joint à sa demande d’habilitation la liste de ses membres.

Chaque parti ou groupement politique auquel ont déclaré se rattacher des élus ou des candidats dans les conditions prévues à l’article LO 1112-10 joint à sa demande d’habilitation la liste de ces élus ou de ces candidats ainsi que leur déclaration de rattachement.

Un arrêté du président du conseil territorial, publié ou affiché au plus tard le troisième vendredi précédant le jour du scrutin, fixe la liste des groupes d’élus, partis et groupements politiques habilités à participer à la campagne ainsi que celle des personnes qui déclarent s’y rattacher.

Tout électeur inscrit à Saint-Barthélemy ainsi que tout groupe, parti ou groupement politique ayant déposé une demande d’habilitation peut, dans les vingt-quatre heures qui suivent la publication de la liste, saisir le tribunal administratif. Le tribunal statue en premier et dernier ressort dans les trois jours suivant le dépôt de la requête.S’il l’estime fondée, le tribunal procède à la réformation de l’arrêté.

Pour l’application des articles du code électoral (partie Réglementaire) à la campagne organisée en vue d’un référendum local, les références aux candidats et listes de candidats sont remplacées par des références aux groupes d’élus, partis et groupements politiques.
