Article D6242-1 of the French General Code of Local Authorities

The local authority of Saint-Barthélemy, where it chooses to transmit all or some of the acts mentioned in Article LO 6241-1, uses a teletransmission system that has been approved under conditions set by order of the Minister for Overseas France.

The approval is subject to compliance with the requirements contained in a specification appended to the order mentioned in the previous paragraph.

No system may be approved if it does not ensure the identification and authentication of the collectivity of Saint-Barthélemy, the integrity of the data flows relating to the acts mentioned in the first paragraph as well as the security and confidentiality of these data.

Article D6242-1

La collectivité de Saint-Barthélemy, lorsqu’elle choisit d’effectuer par voie électronique la transmission de tout ou partie des actes mentionnés à l’article LO 6241-1, recourt à un dispositif de télétransmission ayant fait l’objet d’une homologation dans des conditions fixées par arrêté du ministre chargé de l’outre-mer.

L’homologation est subordonnée au respect des prescriptions contenues dans un cahier des charges annexé à l’arrêté mentionné au précédent alinéa.

Aucun dispositif ne peut être homologué s’il n’assure l’identification et l’authentification de la collectivité de Saint-Barthélemy, l’intégrité des flux de données relatives aux actes mentionnés au premier alinéa ainsi que la sécurité et la confidentialité de ces données.
