Article D6242-3 of the French General Code of Local Authorities

The President of the Territorial Council signs an agreement with the State representative that includes the reference of the approved system and that provides in particular:

a) The date on which the local authority of Saint-Barthélemy is connected to the teletransmission chain;

b) The nature and characteristics of the acts transmitted electronically;

c) The respective commitments of the president of the territorial council and the representative of the State for the organisation and operation of teletransmission;

d) The possibility, for the local authority of Saint-Barthélemy, of waiving transmission by electronic means and the terms and conditions of this waiver.

Le président du conseil territorial signe avec le représentant de l’Etat une convention comprenant la référence du dispositif homologué et qui prévoit notamment :

a) La date de raccordement de la collectivité de Saint-Barthélemy à la chaîne de télétransmission ;

b) La nature et les caractéristiques des actes transmis par la voie électronique ;

c) Les engagements respectifs du président du conseil territorial et du représentant de l’Etat pour l’organisation et le fonctionnement de la télétransmission ;

d) La possibilité, pour la collectivité de Saint-Barthélemy, de renoncer à la transmission par voie électronique et les modalités de cette renonciation.
