Article D632-5 of the French Monetary and Financial Code

The following market infrastructures are subject to the provisions of Article L. 632-17 :

1° Market undertakings that manage a regulated market as defined in Article L. 421-1, or a multilateral trading facility as defined in Article L. 424-1;

2° Central depositories of financial instruments mentioned in 3° of II of Article L. 621-9;

3° Managers of interbank settlement systems and managers of settlement and delivery systems for financial instruments mentioned in Article L. 330-1;

4° The clearing houses referred to in Articles L. 440-1 et seq;

5° Commercial companies that centralise and electronically record data relating to transactions in financial instruments.

Sont soumises aux dispositions de l’article L. 632-17 les infrastructures de marché suivantes :

1° Les entreprises de marché qui gèrent un marché réglementé défini à l’article L. 421-1, ou un système multilatéral de négociation défini à l’article L. 424-1 ;

2° Les dépositaires centraux d’instruments financiers mentionnés au 3° du II de l’article L. 621-9 ;

3° Les gestionnaires de systèmes de règlement interbancaires et les gestionnaires de systèmes de règlement et de livraison d’instruments financiers mentionnés à l’article L. 330-1 ;

4° Les chambres de compensation mentionnées aux articles L. 440-1 et suivants ;

5° Les entreprises ayant le statut de société commerciale qui assurent la centralisation et l’enregistrement électronique de données relatives aux opérations sur instruments financiers.
