The compliance visit provided for in Article L. 6322-1 shall take place within two months of the authorisation holder informing the Director General of the Regional Health Agency that it is in a position to put its facilities into service. It is carried out by at least three persons appointed by the Director General of the Regional Health Agency from among the persons mentioned in Articles L. 1421-1 and L. 1435-7. The Director General of the Regional Health Agency may also call in a person with special qualifications.
Where the result of the inspection is positive, the inspection report or, failing that, a provisional document in lieu thereof, is immediately given to the authorisation holder, allowing him to start operating the facilities.
If the facilities or the organisational or operating procedures do not comply with the authorisation conditions laid down in articles R. 6322-14 to R. 6322-29 or the technical operating conditions laid down in articles D. 6322-31 to D. 6322-47 or the other elements contained in the file provided for in article R. 6322-4 on the basis of which the authorisation was granted, the Director General of the Regional Health Agency will be informed of the findings.
The Director General of the Regional Health Agency will inform the party concerned by registered letter with acknowledgement of receipt, within one month, of the alterations to be made or the measures to be taken to ensure compliance. Commissioning of the facilities is deferred until a new inspection, carried out in accordance with the above conditions, has confirmed compliance.
In all cases, the final reports and minutes are sent to the authorisation holder.
