Article D6332-1 of the French General Code of Local Authorities

The information file provided for in Article LO 1112-8 is made available to the public by the collectivité de Saint-Martin at least fifteen days before the ballot.

The information file is made available to the public at the hôtel de la collectivité. The electors of the collectivity shall be informed by any means.

The file shall include the text of the question to which the electors are called to answer, the draft deliberation or act submitted for their approval and an explanatory report setting out the reasons for and scope of the project and, where applicable, the technical and financial characteristics of its implementation. The file also contains, where applicable, notes, reports, opinions and any other documents required by law or regulation for information prior to decisions being taken by the competent territorial authorities.

It specifies that the result of the referendum will have the force of a decision and mentions the quorum and majority conditions required by the first paragraph of article LO 1112-7 for the project to be adopted.

Le dossier d’information prévu à l’article LO 1112-8 est mis à disposition du public par la collectivité de Saint-Martin quinze jours au moins avant le scrutin.

Le dossier d’information est mis à disposition du public à l’hôtel de la collectivité. Les électeurs de la collectivité en sont informés par tout moyen.

Le dossier comporte le texte de la question à laquelle les électeurs sont appelés à répondre, le projet de délibération ou d’acte soumis à leur approbation et un rapport explicatif exposant les motifs et la portée du projet ainsi que, le cas échéant, les caractéristiques techniques et financières de sa réalisation. Le dossier contient également, s’il y a lieu, les notes, rapports, avis et tous autres documents requis par la loi ou le règlement pour l’information préalable à la prise des décisions par les autorités territoriales compétentes.

Il précise que le résultat du référendum aura valeur de décision et mentionne les conditions de quorum et de majorité exigées par le premier alinéa de l’article LO 1112-7 pour que le projet soit adopté.
