Article D6342-5 of the French General Code of Local Authorities

The transmission to the State representative of the public contracts of the local authority and its public establishments other than public health establishments includes the following documents:

1° A copy of the constituent documents of the public contract, with the exception of the plans;

2° The decision authorising the legal representative of the Saint-Martin local authority or institution to award the public contract;

>
3° A copy of the call for tenders and the invitation to the selected candidates;

>
4° The consultation rules, if they are included in the consultation documents;

> The minutes and reports of the consultation;

The tender documents
5° The minutes and reports of the tendering committee and the opinions of the competition jury, with the names and qualifications of the people who sat on them, as well as the presentation report by the purchaser provided for in articles R. 2184-1 to R. 2184-5 of the Public Procurement Code or the information provided for in articles R. 2184-7 to R. 2184-10 of the same code;

6° The information, attestations and other documents required by articles R. 2184-1 to R. 2184-5 of the Public Procurement Code or the information provided for in articles R. 2184-7 to R. 2184-10 of the same code.
6° The information, certificates and declarations provided pursuant to articles R. 2143-6 to R. 2143-12 and R. 2143-16 of the public procurement code.

Article D6342-5

La transmission au représentant de l’Etat des marchés publics de la collectivité et de ses établissements publics autres que les établissements publics de santé comporte les pièces suivantes :


1° La copie des pièces constitutives du marché public, à l’exception des plans ;


2° La délibération autorisant le représentant légal de la collectivité de Saint-Martin ou de l’établissement à passer le marché public ;


3° La copie de l’avis d’appel à la concurrence et de l’invitation des candidats sélectionnés ;


4° Le règlement de la consultation, si celui-ci figure parmi les documents de consultation ;


5° Les procès-verbaux et rapports de la commission d’appel d’offres et les avis du jury de concours, avec les noms et qualités des personnes qui y ont siégé, ainsi que le rapport de présentation de l’acheteur prévu par les articles R. 2184-1 à R. 2184-5 du code de la commande publique ou les informations prévues par les articles R. 2184-7 à R. 2184-10 de ce même code ;


6° Les renseignements, attestations et déclarations fournis en vertu des articles R. 2143-6 à R. 2143-12 et R. 2143-16 du code de la commande publique.
