Article D6363-2 of the French General Code of Local Authorities

For the application of 20° of Article L. 3321-1, the constitution of provisions for risks and charges and for depreciation of assets is mandatory as soon as the risk arises.

The President of the Territorial Council must set aside the provision for the amount of the risk identified.

The provision must be adjusted annually according to changes in the risk. It shall be written back when it has become irrelevant, i.e. when the risk is realised or when the risk is no longer likely to occur.

The amount of the provision as well as its monitoring and use shall be recorded on the statement of provisions made attached to the budget and the administrative account.

The allocations to provisions made under the conditions defined in this article shall also constitute compulsory expenditure for the school funds.

Pour l’application du 20° de l’article L. 3321-1, la constitution de provisions pour risques et charges et pour dépréciation d’éléments d’actif est obligatoire dès lors qu’il y a apparition du risque.

Le président du conseil territorial doit constituer la provision à hauteur du risque constaté.

La provision doit être ajustée annuellement en fonction de l’évolution du risque. Elle donne lieu à reprise lorsqu’elle est devenue sans objet, c’est-à-dire en cas de réalisation du risque ou lorsque ce risque n’est plus susceptible de se réaliser.

Le montant de la provision ainsi que son suivi et son emploi sont retracés sur l’état des provisions constituées joint au budget et au compte administratif.

Les dotations aux provisions effectuées dans les conditions définies au présent article constituent également des dépenses obligatoires pour les caisses des écoles.
