I.-In Guadeloupe, Martinique, French Guiana and La Réunion, the observatory of prices, margins and incomes mentioned in article L. 910-1 C in addition to its chairman, comprises the following members:
a) The State representative in the overseas department and region and :
the regional director of public finance or his representative;
the regional or inter-regional director of the Institut national de la statistique et des études économiques or his representative;
the regional director of business, competition, consumer affairs, labour and employment or his representative;
b) Members of parliament elected within the jurisdiction of each department and region;
c) The president of the regional council or his representative;
d) The president of the general council or his representative;
e) A mayor of a commune within the jurisdiction of the department and region, proposed by the president of the Association of Mayors;
f) The president of the regional economic, social and environmental council or his representative;
g) Three representatives of the consular chambers:
the president of the chamber of commerce and industry or his representative;
the president of the chamber of trades and crafts or his representative;
the president of the chamber of agriculture or his representative;
h) Eight representatives of private and public sector employee trade union organisations appointed, in accordance with the procedures laid down in the article R. 2623-9 of the Labour Code, by the State representative;
i) Three representatives of employers’ trade union organisations appointed, in accordance with the procedures provided for in article R. 2623-9 of the Labour Code, by the State representative;
j) Three qualified individuals appointed for their expertise or knowledge of price and income formation by the State representative on the proposal of the chairman of the observatory;
k) The regional director of the Institut d’émission des départements d’outre-mer or his representative;
l) One representative of each consumer protection association approved under the conditions set out in articles R. 411-1 et seq. of the Consumer Code.
A vice-chairman is appointed from among the members of the observatory by an absolute majority vote, for a term of office identical to that of the chairman.
II.-.In Mayotte, the observatory of prices, margins and incomes referred to in Article L. 910-1 C comprises, in addition to its chairman, the following members:
a) The State representative in Mayotte as well as :
the regional director of public finance or his representative;
the local representative of the Institut national de la statistique et des études économiques or his representative;
the regional director of companies, competition, consumption, labour and employment or his representative ;
b) Members of parliament elected in Mayotte;
c) The president of the general council or his representative;
d) A mayor of a Mayotte commune proposed by the president of the association of mayors;
e) The president of the economic and social council of Mayotte or his representative;
f) Three representatives of the consular chambers:
-the President of the Chamber of Commerce and Industry or his representative;
-the President of the Chamber of Trades and Crafts or his representative;
-the President of the Chamber of Agriculture, Fisheries and Aquaculture or his representative;
g) Eight representatives of private and public sector employee trade union organisations appointed, in accordance with the procedures set out in Article L. 22121-1 of the Labour Code, by the representative of the State;
h) Three representatives of employers’ trade unions appointed by the representative of the State;
i) Three qualified persons appointed for their expertise or knowledge of price and income formation by the representative of the State on the proposal of the chairman of the observatory;
j) The local director of the Institut d’émission des départements d’outre-mer or his representative;
k) One representative of each consumer protection association approved under the conditions laid down in articles R. 411-1 et seq. of the Consumer Code.
A vice-chairman is appointed from among the members of the observatory by an absolute majority vote, for a term of office identical to that of the chairman.
III.-In Saint-Pierre-et-Miquelon, the observatory of prices, margins and incomes mentioned in Article L. 910-1 C comprises, in addition to its chairman, the following members:
a) The representative of the State in Saint-Pierre-et-Miquelon as well as :
the Director of Public Finance for Saint-Pierre-et-Miquelon or their representative;
the Director of Social Cohesion, Labour, Employment and Population for Saint-Pierre-et-Miquelon or their representative;
b) The Members of Parliament elected in Saint-Pierre-et-Miquelon;
c) The President of the Territorial Council or their representative;
d) The mayors of the communes in the archipelago or their representative;
e) The President of the Economic, Social and Cultural Council or his representative;
f) The President of the Chamber of Agriculture, Commerce, Industry, Trades and Crafts or his representative;
g) Two representatives of private and public sector employee trade union organisations appointed, in accordance with the procedures laid down in Article R. 2623-9 of the Labour Code, by the State representative;
h) Two representatives of employers’ trade unions appointed, in accordance with the procedures laid down in article R. 2623-9 of the Labour Code, by the State representative;
i) Two qualified persons appointed for their expertise or knowledge of price and income formation by the State representative on the proposal of the chairman of the observatory;
j) The local director of the Institut d’émission des départements d’outre-mer or his representative;
k) One representative of each consumer protection association approved under the conditions set out in articles R. 411-1 et seq. of the Consumer Code.
A vice-chairman is appointed from among the members of the observatory by an absolute majority vote, for a term of office identical to that of the chairman.
IV.-In the Wallis and Futuna Islands, the observatory of prices, margins and incomes referred to in Article L. 910-1 C comprises, in addition to its chairman, the following members:
a) The State representative in the territory of the Wallis and Futuna Islands as well as :
-the director of public finance of the Wallis and Futuna Islands or his representative;
-the head of the economic affairs department of the Wallis and Futuna Islands or his representative;
-the head of the customs and miscellaneous contributions department of the Wallis and Futuna Islands or his representative;
b) Members of parliament elected in the Wallis and Futuna Islands;
c) The President of the Territorial Assembly or his representative;
d) The three representatives of the chiefdom of the three kingdoms;
e) A representative of the Economic and Social Consultative Committee;
f) The President of the Chamber of Commerce, Industry, Trades and Agriculture of the Wallis and Futuna Islands or his representative ;
g) Two representatives of representative employee trade union organisations, within the meaning of locally applicable labour law regulations having the same purpose, appointed by the State representative;
h) Two representatives of employer trade union organisations appointed by the State representative;
i) One representative of each consumer protection association;
j) The local director of the Institut d’émission d’outre-mer or his representative;
k) The head of the territorial statistics department or his representative;
l) Two qualified personalities appointed for their expertise or knowledge of price and income formation by the State representative on the proposal of the chairman of the observatory.
A vice-chairman is appointed from among the members of the observatory by an absolute majority vote, for a term identical to that of the chairman’s mandate.
V.-In Saint-Barthélemy, the observatory of prices, margins and incomes referred to in Article L. 910-1-C comprises, in addition to its chairman, the following members:
a) The representative of the State in the collectivity as well as:
the Regional Director of Public Finance for Guadeloupe or his representative;
the Regional Director of the National Institute of Statistics and Economic Studies for Guadeloupe or his representative;
the Director of Business, Competition, Consumer Affairs, Labour and Employment for Guadeloupe or his representative ;
b) The elected Members of Parliament of Saint-Barthélemy;
c) The President of the Territorial Council or his representative;
d) The President of the Economic, Social and Cultural Council of Saint-Barthélemy or his representative ;
e) The President of the multi-professional economic chamber of Saint Barthélemy;
f) Four qualified individuals appointed for their expertise or knowledge of the territory’s economy by the State representative on the proposal of the Observatory President;
g) The director of the Guadeloupe branch of the Institut d’émission des départements d’outre-mer or his representative;
h) One representative of each consumer protection association approved under the conditions set out in articles R. 811-1 et seq. of the Consumer Code.
A vice-chairman is appointed from among the members of the observatory by an absolute majority vote, for a term of office identical to that of the chairman.
VI.-.In Saint-Martin, the observatory of prices, margins and incomes referred to in Article L. 910-1-C comprises, in addition to its chairman, the following members:
a) The representative of the State in the collectivity as well as :
the Guadeloupe regional director of public finance or his representative;
the Guadeloupe regional director of the National Institute of Statistics and Economic Studies or his representative;
the Guadeloupe director of companies, competition, consumption, labour and employment or his representative;
b) The elected members of parliament for Saint-Martin;
c) The President of the Conseil territorial or his representative;
d) The President of the Conseil économique social et culturel de Saint-Martin or his representative;
e) The President of the Chambre consulaire interprofessionnelle de Saint-Martin;
f) Two representatives of private and public sector employee trade union organisations appointed, in accordance with the procedures set out in Article R. 2623-9 of the Labour Code, by the representative of the State;
g) Two representatives of employers’ trade unions appointed in accordance with the procedures set out in article R. 2623-9 of the Labour Code;
h) Two qualified persons appointed for their expertise or knowledge of price and income formation by the State representative on the proposal of the chairman of the observatory;
i) The director of the Guadeloupe branch of the Institut d’émission des départements d’outre-mer or his representative;
j) One representative of each consumer protection association approved under the conditions set out in articles R. 811-1 et seq. of the Consumer Code.
A vice-chairman is appointed from among the members of the observatory by an absolute majority vote, for a term of office identical to that of the chairman.
