Article L1112-18 of the French General Code of Local Authorities

If the deliberation emanates from the deliberative assembly of a territorial community other than the commune, the State representative in this community notifies it within fifteen days to the mayors of the communes in which the consultation is planned, unless his request for suspension has been granted.

The mayors organise the ballot. If a mayor refuses to organise the ballot, the representative of the State, after requesting him to do so, shall do so automatically.

Article L1112-18
