Article L1113-4 of the French Public Health Code

The establishments mentioned in article L. 1113-1 or the State shall only be liable for the theft, loss or deterioration of objects not deposited under the conditions provided for in article L. 1113-1 or not removed under those provided for in the second paragraph of article L. 1113-3, when their holders were in a position to do so, if fault is established against the establishments or against the persons for whom they are responsible.

Les établissements mentionnés à l’article L. 1113-1 ou l’Etat ne sont responsables du vol, de la perte ou de la détérioration des objets non déposés dans les conditions prévues à l’article L. 1113-1 ou non retirés dans celles prévues au second alinéa de l’article L. 1113-3, alors que leurs détenteurs étaient en mesure de le faire, que dans le cas où une faute est établie à l’encontre des établissements ou à l’encontre des personnes dont ils doivent répondre.
